("ANP") dba Allstate Notary Preparation, Allstate Online Notary Preparation and/or California Notary Bond and Insurance Services. At ANP we are serious about protecting your privacy, and this Privacy Statement discloses to those who register how we collect, protect, use, and disclose the Personal Information gathered on this Site. Please read our Privacy Statement and Terms of Use carefully before using this Site and contact us with any questions or comments you may have.

    As a Registered User, your use of this Site is subject to the Terms of Use (of which the Privacy Statement is part of) posted on this Site. The Terms of Use or any part thereof may be revised from time to time through an updated posting, and therefore you should check the Terms of Use (including the Privacy Statement) periodically. Revisions are effective upon posting and your continued use of this Site following the posting of a revision will indicate your acceptance of such revision.     Privacy Statement.

    Personal Information. When you register to use this Site, you must provide the Site with the following information: Your full name, street address, city, state, zip code, phone number, email address and a credit card number and expiration date. We use your Personal Information only to bill your credit card for the Registration Fee, to communicate with you about service-related issues, and to track your site usage in order for you to be eligible for our Refund Policy. Once all the required Personal Information is entered and processed, the you will be required to select a user identification and password that will enable you to access the Site and utilize the Site contents.

    ANP will access a Registered User's Personal Information only on an "as needed" basis and solely to provide services in connection with this Site. ANP will take commercially reasonable steps to keep such information confidential. ANP will not share any such Personal Information with any third party without your consent, except in the following circumstances: (a) in response to subpoenas, court orders or legal process, to the extent permitted and as restricted by law; or (b) when disclosure is required to maintain security and integrity of the Site, or to protect any Site user's security or the security of other persons, consistent with applicable laws. Non-personal information and data may be aggregated for statistical use by ANP and shared with third parties.

    Terms of Use.

    Use. For those who register for the vendor's (1) approved California notary public online course of study or self-study course or (2) Online Notary Signing Agent Course: You agree to pay a one-time Registration Fee as set forth within the Site in order to access and utilize the Site. For those who register to attend the vendor's approved California notary public live course of study: You agree to pay a one-time Registration Fee as set forth within the Site in order to attend the live course of study, and access and utilize the Site. Once ANP has successfully processed your Personal Information, Registration Fee, user identification and password, you will be designated as a Registered User. As a Registered User, you are entitled to access and use the Site for a 4 consecutive-month period starting with the day your registration is processed. Your Registration is personal to you, you agree not to assign, transfer, resell or sublicense your rights as a Registered User unless specifically allowed by ANP. You agree that as a Registered User you are solely responsible and liable for any and all breaches of the terms and conditions of this Agreement, whether such breach results from your use of the Site or by another using your computer. You agree to contact ANP immediately if your password has been compromised or if you become aware of any unauthorized use or access to this site. You agree that ANP may modify the Site at any time, for any reason, and without providing notice of such modification to you. You further acknowledge and understand that (a) the official California Notary Public exam is not currently offered online or on any website (b) you must contact CPS Human Resource Services (https://notary.cps.ca.gov or (916) 263-3520) to register for the Notary Public exam and schedule an exam date and time.

    Refund Policy. For notary courses. Pursuant to section 20800.9. (b) of the California Government Code, if one of the following events occurs, all fees will be refunded within 30 business days of the scheduled course date to any notary public applicant or notary public who registered to attend the approved course of study:

    1. An instructor fails to appear at the scheduled time, date and place of the approved course of study.
    2. An approved course of study is delayed in starting more than 15 minutes after the scheduled time, and the notary public or notary public applicant immediately informs the approved vendor of his or her request for a refund and leaves the approved course of study prior to it starting.

    Registered Users of the vendor's approved California notary public online course of study: You hereby agree to be bound by terms stated herein with regard to site usage and refund policies, and acknowledge that your Registration Fee is non-refundable except for that as stated in this Refund Policy section. If you are a Registered User who completes the approved online course of study but twice fails to pass the state notary public exam within a three consecutive-month period after completing the ANP approved online course of study, ANP will refund your course Registration Fee. In order to be eligible for a refund under this policy, you must read all of the ANP sessions and complete all of the ANP online Activities with a passing score of 80% or greater. You may complete the Activities as many times as you need in order to achieve the passing score. In addition, you must have taken and failed the official California Notary Public exam on two separate occasions, with both occasions having occurred within one day but not more than 180 days from the date you became an ANP Registered User. To obtain your refund you must submit the following Refund Information: Copies of your two official fail letters from the State of California to ANP via certified mail to the mailing address listed above. Upon our verification of the requirements set forth herein, your Registration Fee will be refunded. The Registered User is responsible for all fees payable to the Secretary of State and will not be refunded the cost of any fees paid to the Secretary of State including the fee(s) for the initial exam or any subsequent exams taken.

    Registered Users of the vendor's approved California notary public live course of study: You acknowledge that if you have registered to attend an ANP seminar, your seminar registration fee includes access to the site. You hereby agree to be bound by terms stated herein with regard to site usage and refund policies, and acknowledge that your Registration Fee is non-refundable except for that as stated in this Refund Policy section. ANP makes every effort to accommodate our Seminar Registered Users with regard to seminar attendance and date selection. In the event that a Register User fails to attend or complete the live approved course of study on the date for which he originally registered, he may reschedule to attend a subsequent date provided there are seats available. A rescheduling fee may apply. If you are a Registered User who completes the approved course of study but fails to pass the state notary public exam, you will have the option to attend a subsequent session of the vendor's approved live course of study (and for as many times as necessary to successfully pass the state exam) for no additional fee, provided there are seats available. If you are a Register User who twice fails to pass the state exam after twice completing the vendor's course of study in a consecutive three month period, then upon written request and submission of the Refund Information listed in the paragraph above, you will be refunded the Registration Fee initially paid for the course of study. In addition, you must have taken and failed the official California Notary Public exam on two separate occasions, with both occasions having occurred within one day but not more than 180 days from the date you became an ANP Registered User. The Registered User is responsible for all fees payable to the Secretary of State and will not be refunded the cost of any fees paid to the Secretary of State including the fee(s) for the initial exam or any subsequent exams taken.

    Registered Users of the vendor's notary public self-study course: You hereby agree to be bound by terms stated herein with regard to site usage and refund policies, and acknowledge that your Registration Fee is non-refundable except for that as stated in this Refund Policy section. If you are a Registered User who completes the approved self-study course of study but twice fails to pass the state notary public exam within a three consecutive-month period after completing the ANP approved self-study course of study, ANP will refund $34.95 of your course Registration Fee. In order to be eligible for a refund under this policy, you must read all of the ANP sessions and complete all of the ANP Activities with a passing score of 80% or greater. You may complete the Activities as many times as you need in order to achieve the passing score. In addition, you must have taken and failed the official California Notary Public exam on two separate occasions, with both occasions having occurred within one day but not more than 180 days from the date you became an ANP Registered User. To obtain your refund you must submit the following Refund Information: Copies of your two official fail letters from the State of California to ANP via certified mail to the mailing address listed above. Upon our verification of the requirements set forth herein, your Registration Fee will be refunded. The Registered User is responsible for all fees payable to the Secretary of State and will not be refunded the cost of any fees paid to the Secretary of State including the fee(s) for the initial exam or any subsequent exams taken.

    Registered Users of the vendor's Online Notary Signing Agent Course: You agree that once your Registration Fee has been processed, you are deemed to have accessed the site and you will not be entitled to a refund for any reason whatsoever.

    Supplies. Bonds and Errors & Omissions policies are underwritten by Merchants Bonding Company (Mutual). Seals are manufactured by California Notary Bond and Insurance Services (CNB1). Notary journals are supplied by Notary Rotary.

    For those who have ordered notary bonds, notary seals and/or Errors and Omissions insurance:
    When you receive your commission package from the Secretary of State, you must do the following two items.

    (1) Mail or fax us a copy of your notary commission so we can process your bond. The fax number is (619) 461-8467.
    (2) Mail the original seal certificate of authorization to:

    Your notary seal cannot be processed until we receive your ORIGINAL seal certificate of authorization. DO NOT FAX US A COPY OF YOUR SEAL CERTIFICATE OF AUTHORIZATION. WE MUST RECEIVE YOUR ORIGINAL SEAL CERTIFICATE OF AUTHORIZATION

    The turn around time for your order is approximately 2-5 days from the date we receive your original seal certificate of authorization. Your complete order will be shipped together via Priority Mail unless otherwise requested.

    Indemnity Agreement for Insurance Products. In purchasing notary bonds and/or Errors and Omissions insurance through an ANP website (www.allstatenotary.com or www.californianotarybonds.com), you, as "undersigned," hereby agree to following terms and conditions of the Merchant's Bonding Company (Mutual) Indemnity Agreement :

        This Agreement entered into by and between the undersigned application or applicants and/or indemnitors, herein called the undersigned, and Merchants Bonding Company (Mutual), of Des Moines, Iowa, hereinafter called the Company, witnesseth:
        The undersigned hereby authorizes the _____ Bank of ______ to give MERCNATS BONDING COMPANY (Mutual), hereafter called Company full information upon its request, showing the balance of the undersigned's account at this date, the undersigned certifies that the foregoing statements and declarations are true, and in consideration of the Company executing as surety there herein bond applied for, does hereby promise and agree to pay an annual premium to the Company until such time as the undersigned shall furnish the Company with evidence satisfactory to it or the complete termination of its liability on said bond.
        The undersigned further agrees to indemnify and save harmless the said Company, in connection with any bond executed on behalf of the person or entity named as applicant, for, from and against any and all losses, costs, damages, and expenses of any nature whatsoever, including counsel fees and expenses, and reimburse said Company for loss adjusting expenses and compensation at the rate of $100.00 per day for officers sand $50.00 per day for all other personnel, which may accrue to the said Company by reason of the said Company having become surety on said bonds.
        The undersigned hereby further agrees that the vouchers or other evidence of payments made by the said Company under its obligation of suretyship shall be conclusive evidence against the undersigned of the fact and extent of the undersigned's liability to the said Company under said obligation of the undersigned, whether said payments were made to discharge a penalty thereunder, incurred in the investigation of a claim made thereon or adjusting a loss or claim in connection wherewith, or in completion the work covered thereby, and whether voluntarily made or paid after suit and judgment against said Company.
        If the Company shall set up a reserve to cover any claim, suit or judgment under any such bonds, the undersigned will, immediately upon demand, deposit with the Company a sum of money equal to such reserve, such sum to be held by the Company as collateral security on such bonds, and such sum and any other money or property which shall have been, or shall hereafter be, pledged as collateral security on any such bond shall, unless otherwise agreed in writing by the Company, be available in the discretion of the Company, as collateral security on any other bonds coming within the scope of the Agreement.
        The Agreement shall constitute a Security Agreement of the Company and also a Financing Statement, both in accordance with the provisions of the Uniform Commercial Code of every jurisdiction wherein such Code is in effect. This Agreement shall, if recorded, constitute a consensual lien upon any and all real estate owned by the undersigned a the time or such recording. However, the filing or recording of this Agreement shall be solely at the option of the Company, and the failure to do so shall not release or impair any of the obligations of the undersigned under the Agreement or otherwise arising, nor shall such failure be in any manner in derogation of the right of the Company under this Agreement or otherwise. The user of the Agreement as a Security Agreement, Financing Statement or consensual lien shall in no way abrogate, restrict or limit the rights of the Company under the Agreement or at law or in equity. The undersigned waive all right to claim any property, including homestead, as exempt from levy, execution, sale or other legal process.
        It is further agreed that the terms and conditions of the application shall also apply to increases and/or decreases in the amounts of any and all bonds, and shall also apply to all renewals whether the bond is continuous, renewed by Continuation Certificate or by the filing of a new bond.
        The Company shall have the right, and is hereby authorized, but not required to fill up any blanks left herein, and to correct any errors in the description of any of said bonds, or in said premium or premiums, or in any name or names, it being agreed that such insertion or corrections, when so made, shall be prima facie correct. This application shall be liberally construed so as to fully protect and indemnify the Company, its successors, assigneds and reinsurers. The undersigned appoints any officer of the Company as the attorney-in-fact of the undersigned with full right to execute on behalf of the undersigned any document necessary to carry into effect the intent and purposes of this Agreement.
        Disclosure of Applicant given pursuant to the Fair Credit Reporting Act. You are hereby notified that an investigative consumer report including information as to your character, general reputation, personal characteristics and mode of living MAY be obtained by the Company. You may request in writing from the Company disclosure of the nature and scope of such report if obtained. (This applies to an individual person only.) I acknowledge I have read the preceding Discloser.
        

    Refund Policy for Supplies. All cancelled supplies orders and requests for refunds will incur a minimum $25 cancellation fee. Bonds and Errors & Omissions insurance orders may be cancelled only up until the policy is written - no refund is available after that time. Notary seal orders can only be cancelled up until we receive a faxed/emailed copy of your seal certificate of authorization or your original seal certificate of authorization (whichever we receive first) - no refund is available after that time. All other supply orders (except notary seals, notary bonds and/or errors and omissions insurance policies) may be cancelled any time prior to shipping. All cancelled supplies orders will incur a minimum $25 cancellation fee.

    Tax Preparer Bonds. Will be processed with the requested effective date, unless the requested effective date falls on a weekend or holiday in which case the bond effective date will be the next business day.

    Insurance License Information.     Security. We secure the Personal Information we maintain about our Registered Users on computer servers in an appropriately controlled, secure environment, protected from unauthorized access, use or disclosure. We also use encryption technology when collecting sensitive information such as a credit card number. We do not retain credit card information on our computer servers. While we attempt to ensure the integrity and security of our network and systems, we cannot guarantee that our security measures will prevent third-party "hackers" from illegally obtaining this information. Given the inherent operation and structure of the Internet, you agree that all transmissions are done at your own risk.

    Cookies. The use of cookies is common in the Internet industry. "Cookies" are small data files sent to your browser and stored on your hard drive. We may use cookies to personalize content, control security, measure traffic patterns and collect information on Internet usage. These files do not collect Personal Information about you. Rather, they operate by identifying your browser, saving information regarding your use of a Web site, and providing you with personalized services.

    IP Addresses. An IP address is a number automatically assigned to your computer by your Internet service provider. This Site may collect IP addresses, the associated URLs, domain types, the browser type used to access the Site, the country, state and telephone area code where the users' Internet service provider's servers are located, the pages of this Site that users viewed during their visit and any search terms entered on the Site. Collection of IP addresses is generally for system administration purposes, to gather broad demographic information, to monitor the level of activity on the Site and for security reasons. Personal Information may be linked to IP addresses to protect the security or integrity of the Site.

    Disclaimer of Warranties and Limitation of Liability. The Site is provided to each Registered User "as is" without warranty of any kind. Neither ANP nor any of its suppliers or licensors, employees or agents warrant the service will be uninterrupted or error free or free from viruses or other harmful malicious agents. ANP does not warrant that any data or any files sent by or to you will be transmitted in uncorrupted form or within a reasonable period of time. All representations and warranties of any kind, express or implied, including, without limitation, any warranties of title, non-infringement, fitness for a particular purpose and merchantability are hereby excluded and disclaimed. In any event, ANP's cumulative liability to you for any and all claims relating to the use of the site shall not exceed the total amount of registration fees paid during the immediately preceding 60 day period. You hereby release ANP from any and all obligations, liabilities, and claims in excess of this limitation. ANP is also not liable for any costs or damages arising from or related to your breach of this agreement. Your sole and exclusive remedy under this Agreement are as expressly set forth herein. Some states do not allow the exclusion or limitation of implied warranties, so the above exclusions or limitations may not apply to you.

    Examination Services. ANP contracts with an independent third party company, CPS Human Resource Services, for notary public examination administration. As a convenience to its Registered Users, ANP provides the facilities for CPS to administer the state notary public examination following each ANP seminar. ANP does not guarantee or warranty that CPS will be available to provide examination services at any time. Notary Public examination and application fees as well as any and all fees payable to any company other than ANP will not be reimbursed to any Registered User for any reason by ANP. ANP is not affiliated with CPS Human Resource Services.

    Ownership. This Site is owned and operated by Allstate Notary Preparation, Inc.. The Site contains intellectual property protected under United States copyright laws, international treaty provisions, and other laws. All right, title, and interest in and to the Site, including associated intellectual property rights, are and shall remain with Allstate Notary Preparation, Inc. As a Registered User, you agree to comply with the terms and conditions of this agreement in connection with the Site.     Entire Agreement. This Agreement constitutes the entire agreement and understanding between the parties with respect to its subject matter and supersedes and replaces any and all prior written or oral agreements. In the event that any portion of this Agreement is held to be unenforceable, the unenforceable portion shall be construed in accordance with applicable law as nearly as possible to reflect the original intentions of the parties and the remainder of its provisions shall remain in full force and effect. Nothing contained in this Agreement shall be construed to limit ANP's rights and remedies available at law or in equity. ANP's failure to insist upon or enforce strict performance of any provision of this Agreement shall not be construed as a waiver of any provision or right. Neither the course of conduct between the parties nor trade practice shall act to modify any provision of this Agreement. This Agreement may not be assigned or transferred by you, the Registered User. This Agreement is freely assignable by ANP to third parties.
